1. These terms

These Terms and Conditions apply to your use of the website and to enquiries, bookings, and purchases made through the website for support, pathways, consultations, digital materials, or related offers provided by Lindsay F Wark Limited trading as The Nourished Baby Collective (“TNBC”, “we”, “us”, or “our”).

If a separate written agreement or clearly stated booking-specific terms apply to a particular pathway, package, or bespoke arrangement, those additional terms will take priority to the extent they are inconsistent with these website terms.

2. About the website

The website is intended to help parents and caregivers understand the kinds of support TNBC offers and, where relevant, to enquire, book, or purchase that support.

We try to keep the website accurate and up to date, but we do not promise that every page, price, availability window, or item of content will always be current, complete, or error free. We may update, suspend, or withdraw parts of the site or parts of our offers at any time.

3. Who may enquire or book

You may use the website and book support only if you are at least 18 years old and are the parent, legal guardian, or another person properly authorised to seek support for the child concerned.

You confirm that the information you provide to us is truthful, accurate, and complete to the best of your knowledge, and that you have the right to share any information, videos, photographs, or records you send.

4. How our pathways and support work

TNBC provides educational, developmental, behavioural, and consultative support to help parents make sense of feeding, sleep, routine, and related care decisions. The support we provide is individualised, but it is still based on the information available to us at the time and on the boundaries of a remote support service.

We may decline, postpone, or stop a booking where we reasonably believe the support requested is outside our scope, where the information provided is insufficient, or where a child’s presentation requires hands-on clinical assessment or more urgent medical review.

5. Important health and clinical boundaries

The website, consultations, pathway documents, round-up reviews, videos, emails, and any related materials are provided for information and support purposes. They are not medical diagnosis, treatment, or prescribing.

TNBC does not replace your GP, paediatrician, dietitian, speech and language therapist, feeding team, or any other medical or allied health professional involved in your child’s care.

You remain responsible for decisions about your child and for obtaining appropriate medical care. You should seek professional medical advice where your child is unwell, where you are concerned about hydration, breathing, lethargy, pain, swallowing safety, growth, medication, or any other clinical issue.

You should never ignore, delay, or avoid seeking medical advice because of something you read on the website or because of any support, guidance, or opinion shared by TNBC.

6. No promise of a particular outcome

Every baby, child, and family is different. Feeding behaviour, appetite, sleep, growth, weight change, tolerance, and progress are affected by many variables beyond our control, including health, development, temperament, prior experiences, family circumstances, and medical context.

For that reason, we cannot guarantee a particular result, time frame, intake, weight pattern, or outcome. What we do provide is thoughtful, experience-led support and recommendations tailored to the information you choose to share with us.

7. Fees, payment, and when work starts

Prices are shown on the website or within the booking process in the currency stated at the point of sale.

A booking is not secured until payment has been received in full, unless we have agreed otherwise in writing.

If you ask us to begin providing support during the statutory cooling-off period that applies to distance contracts, you expressly request an early start. If you later cancel within that period, we may retain a proportionate amount for work already carried out. If the relevant service is fully performed during that period, your cancellation right may end once the law allows.

We may use third-party booking, payment, scheduling, and communication platforms. Your use of those platforms may also be subject to their own terms and privacy practices.

8. Moving, cancelling, or changing a booking

We reserve appointment time and pathway capacity in advance. Any request to move, cancel, or otherwise change a booking must be made in writing.

If you ask to move or cancel a consultation with at least two clear working days’ notice before the scheduled start time, we will usually offer either one transfer of that booking or a refund less any non-recoverable third-party payment processing fees actually incurred.

If you ask to move or cancel with less than two clear working days’ notice, the booking will usually be treated as non-refundable. This is because that time has been set aside for your family and we may be unable to offer it to another client at short notice. If there are exceptional circumstances, we may choose to offer one discretionary transfer, but we are not obliged to do so.

If you do not attend, are not available, or are unable to proceed at the scheduled time, the appointment will usually be treated as used.

If forms, records, videos, or other pre-consult information we have requested are not provided in time, we may need to postpone the booking. We cannot guarantee that the original appointment slot can be held.

Where a pathway, add-on, or round-up support period includes a stated support window, it must be used within that window unless we agree otherwise in writing. Unused time does not roll forward automatically.

Once a consultation, written guidance, a pathway document, or any period of live support has been delivered, that part of the service is non-refundable.

If support ends earlier than planned, any unused support days or remaining support time will usually lapse and will not normally be refunded, credited, or carried forward. This reflects the fact that time and availability are reserved in advance for your family. If we choose to make an exception, this will be at our discretion and must be agreed in writing.

Where a package ends early or a family decides not to continue, any refund or credit will be limited to the part of the service that has not yet been delivered, and only where required by law or where we expressly agree otherwise in writing.

Nothing in this section affects any statutory rights you may have as a consumer.

9. Communication boundaries

Any communication included in a booking is limited to the format, channel, and period described on the relevant pathway or booking page, or otherwise confirmed in writing.

Unless we have clearly said otherwise, support is not a real-time messaging service, is not emergency monitoring, and does not include unlimited review of logs, videos, or ad hoc questions outside the agreed scope.

We may set reasonable boundaries around response windows, weekdays of availability, how materials should be sent, and how much review time is included in a booking.

10. Information and materials you send to us

If you send videos, photographs, feeding logs, records, or written updates, you give us permission to review and use those materials for the purpose of considering your enquiry, preparing for your booking, delivering support, and keeping an internal record of the support provided.

If you share information about another adult, or ask us to liaise with a professional involved in your child’s care, you confirm that you have the necessary authority or consent to do so.

11. Intellectual property

All content on the website and all TNBC materials, including wording, pathway names, written plans, frameworks, downloads, graphics, videos, recordings, and supporting resources, remain our intellectual property or are used under licence unless stated otherwise.

You may use materials supplied to you for your own personal, non-commercial family use only. You may not copy, reproduce, republish, sell, adapt, distribute, teach from, or commercially exploit TNBC materials without our written permission.

THE NOURISHED BABY COLLECTIVE is a UK registered trade mark of Lindsay F Wark Limited and must not be used without our consent.

12. Testimonials and shared feedback

If you send us feedback, a testimonial, or kind words, we may ask for permission to use it for educational or marketing purposes.

We will not publish a testimonial, photograph, story, or other client material in a way that identifies you or your child without your express permission.

13. Acceptable use of the website

You must not misuse the website, interfere with its operation, attempt unauthorised access, upload malicious material, scrape content, impersonate another person, or use the website for any unlawful or infringing purpose.

We may suspend or restrict access where we reasonably believe the website is being misused or our rights are being infringed.

14. Privacy, cookies, and embedded content

The website may use essential technologies as well as optional analytics, advertising, or embedded-media technologies. Where the law requires it, we will ask for your consent before using non-essential tools.

15. Liability

Nothing in these terms excludes or limits liability where the law does not allow us to do so, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.

Subject to that, we are not liable for indirect or consequential loss, for loss arising from incomplete or inaccurate information provided to us, for decisions made by you or your child’s clinicians, or for loss arising from circumstances outside our reasonable control.

To the fullest extent permitted by law, our total liability in connection with any website booking, purchase, or pathway will not exceed the amount you paid for the relevant support giving rise to the claim.

16. Other legal points

If any part of these terms is found to be invalid or unenforceable, the remaining parts will continue in force.

We may update these terms from time to time. The version in force at the time of your booking or purchase will generally apply to that booking or purchase unless the law requires otherwise.

These terms are governed by the laws of England and Wales, and disputes will be dealt with by the courts of England and Wales unless a different forum is required by consumer law.
